A woman is suing a Wisconsin Dells waterpark after an accident on a ride in 2012 left her with a traumatic brain injury and permanent disfigurement.
The lawsuit claims Terry E. Kubitz, 50, of Clintonville, was descending in an inflatable raft down a ride at Noah’s Ark waterpark when the raft went over a steep drop-off and part of the raft struck her in the head.
Kubitz was knocked unconscious, the lawsuit states, and suffered multiple injuries, including a traumatic brain injury, a concussion, post concussive syndrome, a displaced orbital fracture, eye injury, facial injuries and neck and back injuries.
Court documents say the injuries resulted permanent disfigurement. Kubitz and her husband are suing the company that owns Noah’s Ark, a California-based firm called Festival Fun Parks, for the cost of medical bills, lost wages, as well as emotional stress, pain and suffering.
The lawsuit claims the company and its employees were negligent in operation of the ride.
