The permit application is being reviewed
under the Prevention of Significant
Deterioration (PSD) Program [ch. NR
405, Wis. Adm. Code] for particulate
matter (PM), volatile organic compounds
(VOC), and and greenhouse gas emissions (CO2e). The proposed sources will
consume the following increments:
PM10, 24-hr – 22.5 μg/m3 out of 30.0 μg
/m3 (75.0%); PM10, annual – 6.78 μg/m3
out of 17.0 μg/m3 (39.9%).
This is a preliminary determination and
does not constitute a final approval from
the Air Management Program or any
other DNR sections which may also
require a review of the project.

(ChemDesign) has requested that certain
information submitted to the department
for the facility located at 2 Stanton St,
Marinette, Wisconsin, be treated as
confidential. This information pertains to
its air compliance information received on
February 8, 2021. The revised public
version of this submittal package and the
revised affidavits were received on March
15, 2021. ChemDesign has sought
confidential status on the emission
calculations containing production process details which are unique and
proprietary to the company.
The Department of Natural Resources
has the authority to compel submittal of
this information under s. 285.61, Wis.
Stats. All information is to be available to
the public, except as provided in s.
285.70(2), Wis. Stats. Under s. 285.70(2),
Wis. Stats., the department may assign
confidential status to the information as
requested by ChemDesign.
NOTICE IS HEREBY GIVEN that the
department has made a preliminary
decision to grant confidential status under
s. 285.70(2), Wis. Stats., and s. NR 2.19,
Wis. Adm. Code, to withhold this
information from the public on the basis
that public disclosure of such information
would have a negative impact on
ChemDesign’s competitive position in
the industry. Any interested person may
obtain an adjudicatory hearing on this
preliminary decision by sending a request
for a hearing to the Secretary of the
Department of Natural Resources, P.O.
Box 7921, Madison, WI 53707. Any
request for a hearing must be submitted
within 10 days of the date of publication of
this Notice.
If a hearing is requested it would be held
before a hearing examiner, testimony
would be under oath, and would be
subject to cross-examination. ChemDesign would have the burden of showing
that its information is entitled to confidential status.

For Part-70 sources, the renewed operation permit will not be issued until after the
United States Environmental Protection
Agency (US EPA) has an opportunity to
review a proposed permit for 45 days. A
draft proposed permit has been provided
to US EPA on the same date this notice
was posted on the Internet. The start date
of the US EPA review period is posted on
the Internet at http://dnr.wi.gov/topic/AirPermits/Search.html. If significant comments are received during the 30-day
public comment period, EPA requests
sequential review, or DNR decides to
proceed with sequential review, DNR will
post a sequential proposed permit to the
website listed above and start US EPA’s
45-day review period after the 30-day
public comment period. DNR’s website
will specify the start date of US EPA’s
45-day review period. Unless US EPA
objects in writing within the 45-day review
period, DNR will issue the final operation
permit renewal as proposed. Any person
may petition US EPA under 40 CFR Part
70.8(d) within 60 days after the expiration
of US EPA’s 45-day review period to
make an objection to the operation permit
renewal.
