It appearing by the attached Application for Examination of Judgment Debtors by Chelsea T. Zielke, one of the attorneys for Plaintiff Eby-Brown Company, LLC in the above-referenced case, that Plaintiff is entitled to an examination of Defendant Singh Mart, Inc. pursuant to Wis. Stat. § 816.03(1)(b);

I DO HEREBY ORDER you, Singh Mart, Inc. (“Singh Mart”), the above-referenced Defendant, to appear before me, the Honorable Bryan Cahill, Court Commissioner for Dane County, Wisconsin, at my office, Godfrey and Kahn S.C., located at One East Main Street, Suite 500, Madison, Wisconsin 53703 on October 2, 2019, at 10:00 a.m. to answer under oath concerning Defendants’ property and to abide by and perform such further orders as I may make.

You are further ordered to mail to:

for receipt by that office on or before September 25, 2019 the following materials and documents:

1. All account statements for any bank account (checking, savings, or otherwise) used by the Company or held in the name of the Company that were created, received, or otherwise applicable at any time from January 1, 2017 through the present.

2. All financial statements (general ledger, balance sheets, income statements, profit and loss statements, and/or statements of net worth) for the Company that were created, received, or otherwise applicable at any time from January 1, 2017 through the present.

3. All federal and state income tax returns (with schedules) for the Company that were created, received, or otherwise applicable at any time from January 1, 2017 through the present.

4. Documents sufficient to identify any actual or potential ownership interest of the Company (or other legal or equitable interest) in any real estate, automobiles, watercrafts, stocks, bonds, bank accounts, certificates of deposit, IRAs, mutual funds, individual securities, promissory notes, insurance policies, patents, trademarks, copyrights, claims, judgments, trusts, or business enterprises at any time since January 1, 2017.

5. Documents sufficient to identify any money, property or other assets owed, or potentially owed, to the Company by any Person at any time since January 1, 2017 including, but not limited to, accounts receivable records.

6. Documents reflecting or evidencing any transfer of cash or other property from the Company to You at any time since January 1, 2017.

7. Documents reflecting or evidencing any transfer of cash or other property from the Company to any third-party on Your behalf since January 1, 2017.

I, Chelsea T. Zielke, having been first duly sworn, state under oath as follows:

1. I am one of the attorneys for Plaintiff Eby-Brown Company, LLC, a Delaware Limited Liability Company.

2. On August 15, 2018, a Stipulated Judgment (the “Judgment”) in the amount of $7,885.85 was entered and docketed in the office of the Clerk of Circuit Court of Cook County, Illinois, County Department, Municipal Division in favor of Plaintiff and against Defendants Singh Mart, Inc., and Mohinder Singh, jointly and severally; and in the amount of $2,355.80 in favor of Plaintiff and against Defendants Mohinder and Sons, Inc., d/b/a Fall River Mobile Mart and Mohinder Singh, jointly and severally. The Judgment was thereafter docketed in Columbia County Circuit Court of Wisconsin on June 26, 2019, and Dane County Circuit Court of Wisconsin on June 27, 2019.

3. Upon information and belief, Mohinder Singh, registered agent for Defendant Singh Mart, Inc., currently resides in Dane County, Wisconsin.

4. The sum of $7,885.85 remains due and unpaid on the Judgment.

5. I make this affidavit for the purpose of obtaining an Order pursuant to Wis. Stat. § 816.03(1)(b) requiring Mohinder Singh, registered agent for Defendant Singh Mart, Inc., to appear before the Honorable Bryan Cahill, Court Commissioner, Dane County, on October 2, 2019, at 10:00 a.m., at his offices located at One East Main Street, Suite 500, Madison, Wisconsin to be fixed by an Order signed by the Commissioner and to answer at that time and place concerning Defendant’s property.
