ORDER TO ABATE PUBLIC NUISANCE

An inspection of the property located at 1938 Vahlen St on 11/19/2018 revealed one or more trees that are dead and/or contain dead wood that cause injury to a person or damage to property. The observed tree(s) include, but are not limited to a mature silver maple located in the backyard of the property (near the NW corner of the house). City of Madison Forestry Specialist Jeff Heinecke observed the tree to have 2 large scaffolding branches (approximately 15" and 22" diameters) that are dead. The tree was also observed to have a trunk wound located at the branch union of the 2 large scaffolding branches. The wound indicates decay and a potential weak union to the large branches that overhang the house. Additionally, the tree was observed to have basal wounds at the root flare, indicating decay and a potentially weak point. In Mr. Heinecke's opinion the tree should be removed. This constitutes a public nuisance as defined in Section 27.05(3)(b)3, of the Madison General Ordinances.

As the owner of the property, you are ordered to abate the nuisance by completely removing the referenced silver maple tree from the property including all branch and trunk pieces. The tree shall be removed on or before 01/01/2019.

Failure to remove and/or trim the trees listed above, will cause the City to abate the nuisance. All costs incurred will be assessed against the real estate as a special charge. There may be additional charges or penalties for failure to comply with this notice. Other applicable Sections: MGO 27.05(3)(a), 27.05(3)(e) and 27.05(2)(f).

Remedy from Order. The Building Code, Fire Code, Conveyance Code & Licensing Appeals Board, created by Section 29.18 of these Ordinances, shall have no authority to act on orders issued under this subsection. Any person affected by orders issued under this subsection shall, within thirty (30) days of service or publication of the order, apply to the Circuit Court for an order restraining the City and the Director of Building Inspection from entering on the premises and abating or removing the nuisance, or be forever barred. The court shall determine the reasonableness of the order for abatement of the nuisance.
